Ratio Decidendi

The Environment and Land Court lacks jurisdiction to stay or prohibit criminal proceedings, as its mandate is confined to disputes relating to environment and land under Article 162(2) of the Constitution and section 13 of the Environment and Land Court Act. Supervisory jurisdiction over criminal proceedings is vested exclusively in the High Court by Article 165(6) and (7) of the Constitution. Furthermore, section 193A of the Criminal Procedure Act expressly provides that the pendency of civil proceedings is not a ground for staying criminal proceedings. The applicant's concerns about conflicting decisions and infringement of rights do not override these jurisdictional limitations....
