Legal Issues
- 1 Whether the applicant has provided sufficient grounds for the transfer of Bondo PM Cr. Case Nos. 691, 692, and 693 of 2019 to another court.
- 2 Whether dissatisfaction with the conduct of the trial magistrate, without specific allegations, is a valid basis for transfer.
Ratio Decidendi
The court held that the applicant failed to provide any specific reasons or evidence to justify the transfer of his cases from the current trial magistrate. Mere dissatisfaction with the manner in which the magistrate is conducting the proceedings, without articulating what has displeased the applicant or how the matters are being mishandled, does not constitute a valid ground for transfer. The application was therefore found to be without merit and dismissed.

RULING
1. I have considered the application for transfer of Bondo PM Cr. Case No. 691, 692 and 693 of 2019 to any other court of competent jurisdiction.
2. The fact that the accused is dissatisfied with the way the trial magistrate is conducting his cases is not reason for transfer as the applicant has not stated what has displeased him or in what manner the matters are being handled.
3. The application is found be devoid of merit and is accordingly dismissed.
4. File closed.
5. Orders accordingly.
