The Tribunal found that the lease agreement between the parties did not specify a formula or rate for rent escalation, and the clause permitting increases was permissive rather than mandatory. Given the lack of evidence supporting either party's preferred rent figure, the Tribunal adopted the Tenant's admitted figure of KES 18,000 per month as the applicable rent from March 2020. The Tenant had paid reduced rent during the COVID-19 period, resulting in arrears of KES 88,000 as at June 2021, a figure acknowledged by the Tenant.
