The court found that the applicant is a beneficiary of the estate and entitled to the parcel of land as per the confirmed grant. The administrators/respondents, despite being served, failed to appear or take steps to effect the transfer, thereby frustrating the applicant's rights. The court held that it is in the interest of justice to grant the orders sought, authorizing the Deputy Registrar to sign all relevant documents to effect the transfer of Machakos/Mua Hills/184 (10 acres) to the applicant, as the administrators have failed in their statutory duty. The application was therefore allowed as prayed.
