Ratio Decidendi

The court found that the cause of action accrued on the date of the applicant's dismissal, 26th January 2012, as pleaded in her memorandum of claim. Section 90 of the Employment Act requires that any suit arising from employment must be filed within three years of the act complained of. The applicant's subsequent appeal or review did not suspend or extend the limitation period. Since the suit was filed on 27th July 2015, more than three years after the date of dismissal, it was time barred. Consequently, the court lacked jurisdiction to entertain the matter and was compelled to dismiss the claim for want of jurisdiction and for being time barred.
