In the interest of justice and to avoid rendering the intended reference nugatory, the court granted a conditional stay of execution, requiring the applicants to deposit Kshs. 500,000 in a joint interest-bearing account within 45 days. Failure to comply would result in the lapse of the stay order. The costs of the application were awarded to the respondent.
