Procedural Posture

Land and Environment Case / Judgment

  1. 1 Whether the plaintiff is the registered proprietor of the suit property.
  2. 2 Whether the defendants trespassed on the suit property and planted bean crop on top of the plaintiff’s wheat crop.
  3. 3 What reliefs should issue to the plaintiff.

Ratio Decidendi

The plaintiff established, through uncontroverted evidence and production of a certificate of title and search, that he is the registered proprietor of the suit property. The defendants neither filed a statement of defence nor adduced evidence to challenge the plaintiff’s case. The court found that the plaintiff’s rights as proprietor are protected under the Land Registration Act and that the defendants’ actions constituted trespass. The defendants’ submissions regarding a boundary dispute were disregarded as they were not pleaded or supported by evidence. Consequently, the plaintiff was entitled to eviction orders, a permanent injunction, and costs as sought in the plaint.

Court Disposition

Judgment for the plaintiff. Eviction and permanent injunction granted. Costs to the plaintiff.
