The High Court lacks jurisdiction to hear appeals from the IEBC Tribunal regarding nomination disputes, as neither the Constitution nor the Elections Act provides for such an appeal. The IEBC Tribunal's mandate to resolve nomination disputes is exclusive, and the High Court can only intervene in exercise of its supervisory jurisdiction through constitutional petitions or judicial review, not by way of appeal. The absence of an express statutory right of appeal indicates legislative intent to preclude such appeals. Therefore, the appeal and the related interlocutory application are not properly before the Court and must be struck out.
