Procedural Posture

Notice of Motion / Ruling on Interlocutory Application

  1. 1 Whether the Plaintiff/Applicant is entitled to an order of temporary injunction restraining the Defendants from dealing with the suit property pending determination of the suit.
  2. 2 Whether an order of inhibition should issue to prevent dealings with the suit property.
  3. 3 Whether the suit should be consolidated with ELC No. 692 of 2014 (OS).

Ratio Decidendi

The court found that the Plaintiff/Applicant had already obtained orders of temporary injunction in the earlier suit (ELC No. 692 of 2014 (OS)), which had since been consolidated with the present suit, and that the lead file was designated as ELC No. 1288 of 2015. As such, the prayers for further temporary injunction and consolidation were rendered unnecessary and superfluous. The court held that it would not issue duplicate orders where relief had already been granted and the procedural posture of the case had been regularized through consolidation. The application was therefore dismissed as it sought orders that had already been addressed by the court in prior proceedings.
