  1. 1 Whether the plaintiff is entitled to an order of eviction against the defendant from L.R. NO.MUGUGA/MUGUGA/T.442.

  3. 3 Whether the allocation of the suit land to the plaintiff was valid or had been revoked.

Ratio Decidendi

The court found that the suit land originally belonged to Kikuyu Town Council and, although it was allegedly allocated to the plaintiff, the allocation was subsequently revoked by the council. The defendant's occupation was with the consent of the local authority, not adverse to its interest. Since the plaintiff's registrable interest in the land was lost due to the revocation, he had no legal basis to seek eviction or mesne profits. The plaintiff's claim was therefore dismissed as untenable.
