Ratio Decidendi

The court found that the defendant had been served with the judgment and decree requiring him to vacate the suit land but had failed to comply. The original judgment rescinded the sale agreement, ordered forfeiture of 25% of the purchase price as damages for breach, and directed the defendant to vacate within 30 days. The defendant's continued occupation of the land was therefore unlawful. The court held that there was no reason to decline the eviction application and granted the order for eviction, authorizing the plaintiff to appoint a court bailiff and directing police to provide security for execution. The defendant was also ordered to bear the costs of the application and eviction.
