Ratio Decidendi

The court found that the applicant satisfied all the conditions for grant of stay of execution pending appeal. The application was filed promptly, within 14 days of the decision. The applicant demonstrated the risk of substantial loss as the respondent did not prove ability to refund the decretal sum if the appeal succeeds. Adequate security was provided by depositing the entire decretal amount in a joint interest earning account in the names of both parties’ advocates. Consequently, the court exercised its discretion to grant stay of execution pending the hearing and determination of the appeal, with the deposited security deemed sufficient.
