Ratio Decidendi

The court found that L.R. No. 1144/17/XXIX is not registered in the name of the deceased and that the beneficial interest claimed by the estate has not been declared by a competent court. The issue of ownership is pending before another court in a suit for adverse possession. The court held that it is not the proper forum to determine ownership based solely on affidavits and that the inclusion of the disputed property in the rectified certificate of confirmation of grant should be deleted. The court ordered that possession and occupation of the property shall not be interfered with pending the determination of the ownership suit, and each party shall bear its own costs.
