There was no evidence that this order had been set aside or varied. The Plaintiffs' application for an interlocutory injunction in the present suit was therefore an attempt to circumvent the existing court order, amounting to an abuse of process. Furthermore, the Plaintiffs had not obtained individual title deeds for the plots and the question of ownership could only be determined at trial.
