Legal Issues
- 1 Whether the sentence imposed on the appellants is appropriate considering the circumstances of the offence and their mitigation.
- 2 Whether the appellants' status as repeat offenders and the severity of the violence warrant the maximum sentence.
Ratio Decidendi
The court found that the appellants were repeat offenders and that their actions resulted in the loss of life, with violence described as vicious. The court determined that these aggravating factors outweighed the mitigation offered by the appellants, such as the period spent in custody. Consequently, the court held that the case warranted the maximum sentence prescribed by law, which is life imprisonment, to reflect the seriousness of the offence and to serve as a deterrent to similar conduct.
Court Disposition

(CONSOLIDATED)
BETWEEN
BENSON MUTHAURA MARETE.................1ST APPELLANT
JAMES KITHIA ITHAI..................................2ND APPELLANT
AND
REPUBLIC............................................................RESPONDENT
SENTENCING
1. I have considered the mitigation by the appellant. That he has been in custody for a long time. I have also considered the sentiments of the state.
2. I have considered the Presentence Report dated 02/11/12. That the accused is a repeat offender, that out of his act a life was lost. The violence metted out on the victims was vicious. This is a fit case for maximum sentence.
3. I hereby sentence the accused to life imprisonment. Right of Appeal 14 days explained.
