The Tribunal found that the 2nd Respondent failed to comply with the mandatory requirements of Rules 11 and 12 of the Auctioneers Rules by not indicating the value of the attached motor vehicles in the proclamation notice. This procedural defect rendered the proclamation invalid. The Tribunal further held that the existence of other suits involving the same vehicles did not bar execution in this matter, as there was no order staying execution or establishing that the Tribunal lacked jurisdiction to proceed.
