The applicant's sentence was imposed after consideration of mitigation and the principles in Muruatetu, and was not a mandatory minimum sentence. Therefore, the applicant's recourse, if dissatisfied, lies in an appeal to the Court of Appeal, not in a review or resentencing application before another High Court judge. The application for resentencing and habeas corpus is thus without legal basis and must be dismissed.
