The last hearing date was 4th November 2014, when the matter was adjourned. In the absence of the appellant and with no withdrawal on record, the court exercised its discretion under Rule 102(1) of the Court of Appeal Rules to dismiss the appeal for non-appearance. Given that the respondent was also not ready to proceed, the court ordered that each party bear its own costs.
