The court found that the claimant's termination was both unfair and unlawful as the respondent failed to provide any evidence of due process or justification for the dismissal. The respondent did not appear or defend the suit, leaving the claimant's evidence uncontroverted. The court held that the claimant was not subject to the TSC Circular as he was not a TSC-employed teacher. The claimant was therefore entitled to compensation for unlawful termination equivalent to 12 months' salary at the rate of Kshs. 14,000 per month, as well as costs and interest. The claim for salary arrears based on the TSC Circular was rejected, but the claim for compensation under the Employment Act was allowed.
