Civil Appeal / Ruling on Application for Leave to Appeal Out of Time

  1. 1 Whether the High Court has jurisdiction to entertain an intended appeal relating to a work injury claim.
  2. 2 Whether leave to file an appeal out of time should be granted in light of jurisdictional constraints.

Ratio Decidendi

The High Court lacks jurisdiction to entertain appeals arising from work injury claims, as such matters fall within the exclusive appellate jurisdiction of the Employment and Labour Relations Court. The applicant's intended appeal, being related to a work injury dispute, cannot be entertained by this court. The allocation of a civil appeal number was premature, as the application for leave to appeal out of time should have been filed before the Employment and Labour Relations Court. Consequently, the application and intended appeal are dismissed for want of jurisdiction.

Court Disposition

application dismissed for lack of jurisdiction

Orders

  • The applicant's application dated 27.3.2018 and the intended appeal are dismissed for lack of jurisdiction.
  • Each party to bear their own costs.
