The court found that the plaintiff's claim was barred by the doctrine of res judicata under Section 7 of the Civil Procedure Act, as the subject matter and parties were identical to those in a previous suit (Kisii HCCC No. 20 of 1999) which had been fully heard and determined. The court held that it could not entertain a claim that had already been adjudicated by a competent court. Furthermore, even on the merits, the plaintiff failed to prove ownership of the suit property as he did not fulfill his part of the exchange agreement, lacking the capacity to transfer Plot No. 29B. The agreement thus failed for want of consideration, and there was no basis for declaring the plaintiff the owner...
