Procedural Posture

Judicial Review / Ruling on Application for Recusal of Judge

  1. 1 Whether the judge should recuse himself from hearing the matter due to allegations of bias by the plaintiff.
  2. 2 Whether the plaintiff's allegations of bias are substantiated and warrant judicial disqualification.

Ratio Decidendi

Although the applicant's allegations of bias are without merit and no good reason has been provided for recusal, the perception of bias by the applicant places the judge in an untenable position. If the judge were to proceed, any decision would be tainted by allegations of unfairness, regardless of the outcome. To maintain public confidence in the judiciary and ensure the appearance of impartiality, the judge finds it necessary to recuse himself from the matter and directs that the file be placed before the Chief Justice for reallocation.

Court Disposition

Judge recused himself from the matter.

Orders

  • The judge recuses himself from hearing the matter.
  • The Deputy Registrar is directed to place the file before the Chief Justice for appointment of another judge.
