Ratio Decidendi

The court found that the Respondent failed to provide any reason for the Claimant's termination and did not follow the mandatory procedural requirements set out in the Employment Act, 2007. The assertion that the contract allowed termination without reason was rejected in light of statutory provisions requiring substantive and procedural fairness. The deduction from the Claimant's salary for the broken lens was also found to be unlawful, as it was effected without due process or an opportunity for the Claimant to be heard. Consequently, the termination was declared unfair, and the Claimant was awarded compensation, notice pay, and a refund of the deducted amount.
