Furthermore, the dismissal of the miscellaneous application by the High Court on 19th September 2019 rendered the present application for leave to appeal and stay of execution moot, as its substratum no longer existed. Consequently, the application filed on 10th June 2019 could not proceed and was dismissed with costs.
