Ratio Decidendi

However, upon its own motion, the court identified and acknowledged arithmetical and clerical errors in its judgment dated 20.1.2020 regarding the calculation of compensation and leave entitlements. Exercising its powers under Rule 34 of the Employment and Labour Relations Court (Procedure) Rules, 2016, the court rectified the errors to reflect the correct amounts: compensation for unfair termination (8 months' salary at Kshs. 12,000 per month) and leave for 8 years, resulting in a revised total award. The rest of the judgment remained unchanged.
