Ratio Decidendi

The High Court held that Section 38(1) of the Small Claims Court Act expressly limits appeals from the Small Claims Court to the High Court to matters of law only. The majority of the Appellant's grounds of appeal raised issues of fact or mixed fact and law, contrary to this statutory limitation. The Court found that only ground 7 of the memorandum of appeal raised a pure question of law and was therefore compliant with Section 38(1). The Court further held that the filing of the appeal in the Civil Division, rather than the Commercial Division, did not affect the Court's jurisdiction, as divisions are administrative and do not alter the High Court's substantive jurisdiction....
