The Tribunal found that it had jurisdiction to hear and determine the dispute because the tenancy in question met the statutory definition of a controlled tenancy under Cap 301, being a written lease for five years. The change of ownership from the previous landlady to the current Landlord did not extinguish the Tenant's rights under the controlled tenancy. The Landlord's notice of termination was found to be valid and in compliance with Section 4 of Cap 301. The Tribunal held that the Tenant was entitled to remain in possession until the expiry of the notice period, after which vacant possession must be given to the Landlord.
