The court held that it could not grant the orders sought because the appeal was incompetent, having been filed out of time without leave, and that appellate jurisdiction under Order 42 Rule 6 of the Civil Procedure Rules can only be exercised where there is a competent appeal. The court further held that a party cannot pursue both an appeal and a review of the same decision, as the remedies are mutually exclusive. The application for review was therefore misconceived and incompetent.
