Ratio Decidendi

The court found that the mandatory death sentence imposed on the applicant was unconstitutional following the Supreme Court's decision in Muruatetu. The court further determined that the applicant's mitigation and the period spent in custody prior to sentencing were not considered at the time of the original sentence. Taking into account the applicant's rehabilitation efforts, time spent in custody (5 years 3 months before sentencing and 7 years on death row), and the need for individualized sentencing, the court set aside the death sentence and substituted it with a term of 20 years imprisonment, effective from the date of the original sentence (1st September, 2016).
