The Tribunal found that its jurisdiction under Section 40 of the Political Parties Act is only invoked where there is a dispute between a party member and a political party that remains unresolved after the party's internal dispute resolution mechanism (IDRM) has been attempted. In this case, the applicant was not aggrieved by the decision of the UDA's Electoral and Nomination Dispute Resolution Committee (EDRC), and there was no evidence that the IEBC had acted contrary to that decision.
