The court found that in medical negligence claims, the accrual of the cause of action is not always tied to a single event but may be sustained over time. Upon reviewing the pleadings, the court determined that the plaintiff began to suffer complications attributable to the alleged negligence in 2018, and thus the limitation period began to run at that time. Since the suit was filed in December 2020, the statutory three-year period had not lapsed. The court therefore held that the suit was not statute barred and that it had jurisdiction to hear the matter. The preliminary objection was dismissed with costs to the plaintiff.
