Section 14 of the Civil Procedure Act allows a plaintiff to file suit either where the wrong occurred or where the defendant resides. Since neither Spain nor the Netherlands falls within the jurisdiction of the Kenyan courts, and given the inconvenience and impracticality of enforcing any judgment in Kenya, the court held that the suit was untenable. The application for security for appearance was therefore dismissed as the court could not proceed without jurisdiction.
