Legal Issues
- 1 Whether the court can entertain an application after the suit has been dismissed for want of prosecution.
- 2 Whether the dismissal by Judge Nyamweya remains binding in the absence of an appeal or review.
Ratio Decidendi
The court held that since the suit was dismissed for want of prosecution by Judge Nyamweya on 25/11/2011, and no appeal or review was undertaken, the dismissal stands. The court therefore lacked jurisdiction to entertain the subsequent application dated 13/6/12. The court abided by the earlier dismissal, reinforcing the principle that once a suit is dismissed for want of prosecution, no further proceedings can be entertained unless the dismissal is set aside through proper legal channels.
Court Disposition
Application not entertained; suit remains dismissed for want of prosecution.
Orders
- The court abides by Judge Nyamweya’s decision dismissing the suit.
- No further proceedings will be entertained in this matter unless the dismissal is set aside.

RULING
Upon perusal of the proceedings of this matter, I have discovered that, this suit was dismissed for want of prosecution by Judge Nyamweya on 25/11/2011. No appeal or review of this decision was undertaken.
Accordingly, this court should not have entertained the application dated 13/6/12. The court, therefore abides by Judge Nyamweya’s decision dismissing this suit.
