Family Appeal / Ruling on Post Appeal Contempt Application

  1. 1 Is the application for contempt competent given the uncommissioned affidavit?
  2. 2 Does the application have merit in alleging disobedience of court orders?
  3. 3 Is the High Court functus officio after delivering its appellate judgment, and thus without jurisdiction to enforce the lower court's orders?

Ratio Decidendi

The application for contempt is incompetent because it is supported by an uncommissioned affidavit, rendering it legally invalid. Even if the application were competent, the High Court, having dismissed the appeal and issued no positive orders, is functus officio and lacks jurisdiction to enforce the lower court's orders. The proper forum for enforcement is the children's court. There is also insufficient clarity and notice regarding the terms of the order allegedly disobeyed. Accordingly, the application is dismissed for want of merit and jurisdiction.
