Ratio Decidendi

The court found that the applicants, having already filed a stay application at the Court of Appeal, improperly sought and obtained interim stay orders from the trial court without disclosing the existence of the parallel application. This non-disclosure constituted a serious abuse of the court process. The trial court, being functus officio once the appellate court was seized of the stay application, lacked jurisdiction to entertain the applicants' request for stay. The court therefore dismissed the application for stay of execution, holding that the applicants' conduct was misleading and unjustified, and awarded costs to the claimant.
