The Court of Appeal held that it lacked jurisdiction to entertain the intended appeal because Section 81(3) of the Co-operative Societies Act expressly provides that the decision of the High Court on appeal from the Co-operative Tribunal is final. As such, there was a statutory bar to further appeals to the Court of Appeal. Consequently, the applicants could not demonstrate that they had an arguable appeal.
