The Tribunal held that the High Court's conditional stay of execution lapsed due to the respondents' non-compliance with the requirement to deposit Kshs. 12,000,000 in an interest-earning account. In the absence of a valid stay, the Tribunal's judgment and decree of 2nd September 2021, together with all consequential orders, became fully enforceable. The Tribunal found that courts should not be used to delay execution through vexatious applications and appeals.
