Miscellaneous Application / Ruling on Habeas Corpus Application

  1. 1 Whether the court can grant a writ of habeas corpus when the subjects have already been deported.
  2. 2 Whether the respondent disobeyed the court order for production of the subjects.

Ratio Decidendi

The court found that since the subjects of the habeas corpus applications had already been deported, there were no persons to produce before the court. As such, the applications for habeas corpus had been overtaken by events and could not be granted. The court further held that any question regarding disobedience of its orders by the respondent could only be determined if and when the court is properly moved and evidence is adduced. Therefore, the applications were dismissed as moot, with liberty to the applicants to pursue any further action as they may deem fit.

Court Disposition

applications dismissed as overtaken by events

Orders

  • The consolidated habeas corpus applications are dismissed as overtaken by events.
  • Any further action shall be determined by the applicants themselves.
