The 1st Defendant had no legal capacity to transfer the suit land to the 2nd Defendant in 1994 as the estate of the deceased had not been succeeded and he was not the registered owner. The purported sale and subsequent registration of the 2nd Defendant as owner were fraudulent, lacking any valid agreement, documentary evidence, or Land Control Board consent. The criminal conviction of the 2nd Defendant for fraudulently acquiring the title, upheld on appeal, is conclusive evidence of fraud.
