The Court found that the applicant had demonstrated an arguable appeal and that the sums ordered for maintenance and school fees were substantial enough that, if paid, could cause him substantial loss and potentially render the appeal nugatory. However, the Court also recognized the need to protect the best interests of the children and not to make orders that would adversely affect their welfare. The Court therefore granted a partial stay: execution of arrears of maintenance and school fees for N accruing before 21st January 2009 was stayed, but the applicant was ordered to pay maintenance for both children at a reduced rate of Shs.50,000 per month and to pay their respective school fees...
