Procedural Posture

Criminal Revision / Ruling on Application for Sentence Revision

  1. 1 Whether the High Court has jurisdiction to revise a sentence already determined by a judge of concurrent jurisdiction.
  2. 2 Whether the doctrine of functus officio bars the court from entertaining the application for resentencing.
  3. 3 Whether the applicant's time spent in custody should be considered in sentencing.

Ratio Decidendi

The High Court lacks jurisdiction to revise or reconsider a sentence already determined by a judge of concurrent jurisdiction. The doctrine of functus officio applies, rendering the court powerless to revisit or alter such decisions. The Constitution and the Criminal Procedure Code do not confer authority on the High Court to sit on appeal or revision over its own decisions or those of another judge of equal status. Accordingly, the application for sentence revision must fail for want of jurisdiction.
