Ratio Decidendi

The High Court lacks jurisdiction to transfer a suit from one subordinate court to another where the suit was originally filed in a court without territorial or pecuniary jurisdiction. Section 18 of the Civil Procedure Act does not empower the High Court to cure the defect of want of jurisdiction in the originating court by ordering a transfer. The applicant's mistake in filing the suit at Nakuru Chief Magistrate's Court, which lacked jurisdiction over land situated in Busia District, cannot be remedied by transfer. The application is therefore without merit and must be dismissed with costs to the respondent.
