The Tribunal held that the Kenya Bureau of Standards (KEBS) is vested with statutory authority under the Standards Act and Legal Notice 78 of 2020 to re-inspect and test imported goods at the port of entry, even where a Certificate of Conformity (CoC) has been issued at the port of origin by an appointed inspection body. The Tribunal found that the powers conferred upon KEBS are unfettered and that its findings at the port of entry take precedence over any prior certification. The Tribunal further determined that no other government body, including the Ministry of Roads and Transport, is authorized to override KEBS's conformity assessment, and any conflicting test results from such bodies...
