Procedural Posture

Environment and Land Case / Ruling on Preliminary Objection and Joinder Application

  1. 1 Whether the Plaint dated 11th October 2022, based on a license, discloses a reasonable cause of action capable of being ventilated before the court.
  2. 2 Whether the proposed 2nd Defendant has an interest or stake in the subject suit and if so, whether joinder would enable the court to determine all issues in controversy.

Ratio Decidendi

The court found that the Plaintiff, as a mere licensee, did not acquire any proprietary or possessory rights in the parking space. The license was revocable and did not confer an interest capable of supporting a claim for declaratory or injunctive relief against the licensor. The Plaintiff's suit, being anchored solely on a license, did not disclose a reasonable cause of action that could be ventilated before the court. As such, the suit was liable to be struck out. Regarding the joinder application, although the proposed 2nd Defendant had a stake in the dispute, the court held that joinder could not be granted where the primary suit itself was unsustainable and was being struck out.

Court Disposition

Plaintiff's suit struck out for failure to disclose a reasonable cause of action. No order as to costs.
