Ratio Decidendi

The court found that the applicant had established that the 1st respondent failed to satisfy the decretal sum and that execution efforts had been futile due to the inability to trace any assets. Under Order 22 Rule 35 of the Civil Procedure Rules, the court has jurisdiction to summon company officers for oral examination and to compel production of documents to aid in execution. The court held that it is in the interest of justice to grant the orders sought, as this would facilitate enforcement of the decree. The court further noted that only upon such examination could it consider lifting the corporate veil and holding the directors personally liable if warranted.
