Ratio Decidendi

The court found that the prosecution had proved the charge of defilement beyond reasonable doubt. The complainant's evidence was credible, consistent, and corroborated by medical evidence and eyewitness testimony from her father. The appellant was properly identified as the perpetrator. However, the court held that the mandatory life sentence under Section 8(2) of the Sexual Offences Act was unconstitutional to the extent that it removed judicial discretion, as established in Maingi & 5 others v DPP. Accordingly, while upholding the conviction, the court substituted the life sentence with a term of 15 years' imprisonment, commencing from the date of arrest.
