The applicant was not under disability when his right of action arose on 14th October 2011; his illness and incapacity occurred after the limitation period had begun to run and near its expiry. The law does not recognize subsequent or supervening disability as a ground for extension, nor does it recognize sickness as a qualifying disability for limitation purposes.
