The tribunal found that the landlord's claim for Kshs 67,500 in rent arrears was not supported by the reconciled rent accounts, which showed that the tenant had overpaid in earlier years and that the landlord had unlawfully closed the premises, denying the tenant access from June 2021 to September 2023. The tribunal excluded the period of closure from the computation of rent arrears and determined that the actual arrears as at 31st January 2024 amounted to Kshs 29,104. The landlord's notice to vacate was found invalid for not complying with the statutory requirements under Cap. 301, rendering the prayer for vacant possession unsustainable. Each party was ordered to bear their own costs...
