The court found that the PPDT erred in setting aside its own judgment of 25th May 2017 without a proper application or sufficient basis, especially after finding that service on the 2nd Respondent had been demonstrated by affidavit. The absence of the 2nd Respondent from the proceedings could not be excused in light of the evidence of service. Furthermore, the court held that the subsequent gazettement of the Appellant as the ODM nominee by IEBC rendered the PPDT's interim injunction and related orders ineffective and overtaken by events.
