Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal.
  2. 2 Whether the interest on the decretal sum was properly calculated by the trial court.
  3. 3 Whether the applicant will suffer substantial loss if stay is not granted.

Ratio Decidendi

The court found that the applicant had demonstrated sufficient cause for the grant of stay of execution pending appeal. The award of the trial court, when compared with the interest charged, showed that the applicant would suffer irreparable loss if stay was not granted. The applicant's readiness to furnish security for costs and the decretal sum satisfied the legal requirement for security. The court was satisfied that the appeal was arguable and that the application had been made without unreasonable delay. Accordingly, the court exercised its discretion to grant a stay of execution on condition that the applicant deposits the decretal sum (excluding interest) in court within seven days.
